Terms of Service for Local / Hourly / Outstation / Drop Driver services from Driver suvidha

This Terms and Conditions agreement (hereinafter referred to as the "Agreement") is a legally binding contract between you (hereinafter referred to as "Customer," "Client," "User," or "you") and Driver suvidha, owned and operated by Driver suvidha (hereinafter referred to as "Driver Suvidha," "we," "us," or "our"), governing your use of our services provided through our website, mobile application, call center, and any other platform operated by driversuvidha.com (collectively referred to as the "Platform or Website").

By registering as a customer on driversuvidha.com or by accessing and using our services through any of our platforms, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree with any part of these terms, please do not use our services.

1. Registration and Personal Information

By registering as a customer, you agree to provide accurate and complete personal information, including your name, email address, mobile number, address, and vehicle details. We collect this information to facilitate the provision of our services and ensure a seamless experience for you.

2. Acknowledgment of Terms

By accepting our service, the customer acknowledges that they have read, understood, and agreed to the aforementioned terms and conditions. It is the customer's responsibility to be aware of and comply with these terms during the service period.

3. Essential Documents

The customer must ensure that the vehicle being used for the service possesses valid documents, including the RC book, insurance copy, and Pollution Under Control (PUC) certificate. These documents are mandatory & vital for a smooth service experience.

4. Safety Precautions

The customer agrees not to cause any distractions or disturbances during the service, ensuring both their safety and the driver's safety on the road. Distractions, whether verbal or otherwise, can compromise the safety of everyone involved.

5. Tinted Glasses and Dark Films

The driver or the company cannot be held responsible if the customer's vehicle has tinted glasses or dark films, especially if this leads to police intervention or penalties.

6. Service Description

Driver suvidha operates as an aggregator platform, connecting Customers with nearby Drivers willing to provide designated driving services. While we strive to ensure timely service, various factors may affect service quality. We do not accept responsibility for delays unless they are purposeful. Our drivers will wait for a maximum of 30 minutes at the specified location; any delay beyond this period will result in the trip starting, and charges will apply.

7. Booking and Cancellation

Customers can cancel bookings within 45 minutes before the scheduled journey without incurring cancellation charges. However, cancellations made after the Driver has started towards the location will result in a cancellation fee of Rs 250/-. The payment is made directly to the driver.

8. Payment and Refunds

Upon trip completion, the fare amount will be displayed on your mobile device, and you can pay either in cash or through electronic means, subject to the Driver's agreement. Any payment-related issues, except those caused by our platform, should be resolved directly between you and the payment processor. Driver suvidha is not liable for unauthorized use or false claims.

9. Limitation of Liability

The driver's responsibility is confined to operating the customer's vehicle safely. The driver from driver suvidha does not assume any liability for fire, theft, loss, or damage to personal belongings. Additionally, the driver cannot be held responsible for injuries resulting from faulty vehicle brakes or poor vehicle conditions.

10. Termination and Access

Driver suvidha reserves the right to deny access to Users, limit features, or terminate accounts without prior notice if users violate the terms, mistreats the driver in any manner that endangers the safety or well-being of either party, provide false information, interfere with others' use, or in case of technical issues. Certain provisions, including Intellectual Property Rights and Prohibited Uses, will remain in effect even after account termination.

11. Indemnity

Customers agree to defend, indemnify, and hold Driver suvidha, its affiliates, licensors, and employees harmless from any claims, costs, damages, and liabilities arising from violation of this Agreement or applicable laws, third-party rights, or misuse of the platform.

12. Miscellaneous

This Agreement constitutes the entire agreement between you and Driver suvidha regarding the use of our platform. We reserve the right to update our Terms and Conditions without notice. Users are responsible for checking the latest terms.

13. Jurisdiction

Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
